During this webinar, Maury Baskin will discuss recent significant regulatory actions and decisions at the National Labor Relations Board.
Learn about the following final rules:
- • Modifications to the Obama-era “Ambush” Election Rule. Effective on April 16, the new final rule scales back the 2014 “ambush” election final rule, also known as Representation-Case Procedures. While the new final rule does not completely rescind the Obama-era rule, it does make significant changes such as permitting employers additional time to comply with pre-election requirements and clarifying the procedure for litigating and resolving unit scope and voter eligibility issues prior to a union election.
- • Joint Employer Final Rule. On Feb. 26, the NLRB issued its long-awaited final rule on the standard for determining joint-employer status under the National Labor Relations Act. Effective April 27, the final rule clearly delineates and limits the types of control that would be treated as creating joint-employer status under the NLRA. With further clarification of the standard, construction contractors will be better able to work and coordinate with multiple employers without fear of being unexpectedly and unfairly found to be joint employers.
In addition, Mr. Baskin will discuss significant NLRB decisions such as upholding property rights for employers in cases involving union organizers and restoring employers’ right to restrict email use.
